Meridian Terms of Use

These Terms of Use ("Terms") are an agreement between you and Norium ("Norium", "we", "us", or "our"), a company registered in Washington State, USA, governing your use of Meridian (the "App"). By downloading, accessing, or using the App, you agree to these Terms and acknowledge our Meridian Privacy Policy. If you do not agree, do not use the App.

You are solely responsible for your health decisions, including whether, when, and how long to fast.

You must be at least 18 years old and able to form a binding contract to use the App. By using the App, you confirm that you meet these requirements.

Some features require an account. You agree to provide accurate information, keep your sign-in credentials secure, and tell us promptly at support@norium.io if you believe your account has been compromised. You are responsible for activity under your account. You can delete your account at any time in the App.

Some features of the App require a paid, auto-renewing subscription purchased through Apple's App Store. The price, billing period, and included features are shown in the App before you subscribe.

• Payment is charged to your Apple ID account when you confirm your purchase.
• Auto-renewal: your subscription renews automatically at the same price and period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Free trials: if a free trial is offered, any unused portion is forfeited when you purchase a subscription, and the subscription begins automatically when the trial ends unless you cancel at least 24 hours before.
• Managing and cancelling: manage or cancel your subscription in iOS Settings → [your name] → Subscriptions. Deleting the App or your Meridian account does not cancel your subscription.
• Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
• Price changes: we may change subscription prices. Apple will notify you in advance and, where required, ask for your consent before a price increase applies.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. Norium and its licensors own all rights in the App, including its design, code, and content. All rights not expressly granted are reserved.

You own the data you enter in the App, including fasting records, weight entries, notes, and progress photos ("Your Content"). You grant us a limited license to host, store, and process Your Content only as needed to operate the App for you, as described in our Privacy Policy. Progress photos remain on your device and are not uploaded to us.

You are responsible for keeping your own backups. Because progress photos are stored only on your device, we cannot recover them if your device is lost or the App is deleted.

You agree not to:

• Copy, modify, reverse engineer, or create derivative works of the App, except as permitted by law
• Access the App or our servers through automated means or interfere with their operation or security
• Circumvent subscription checks or access paid features without paying
• Use the App in violation of any applicable law

If you downloaded the App from Apple's App Store, you and we acknowledge that:

• These Terms are between you and Norium only, not Apple, and Norium, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Norium, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
• If a third party claims that the App or your use of it infringes their intellectual property rights, Norium, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce them against you as a third-party beneficiary.

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will achieve any particular health or weight result.

To the fullest extent permitted by law, Norium will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the App. Our total liability for any claim relating to the App is limited to the greater of the amount you paid for the App in the 12 months before the claim or US $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

To the extent permitted by law, you agree to indemnify and hold Norium harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the App or violation of these Terms.

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or if we discontinue the App. If we discontinue the App, we will give reasonable notice where possible. Sections that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of law rules. Any dispute will be resolved exclusively in the state or federal courts located in Washington, and you and Norium consent to their jurisdiction. If you are a consumer in the EEA or UK, you also benefit from any mandatory protections of the law of your country of residence and may bring claims in your local courts.

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, notify you in the App before they take effect. Continuing to use the App after changes take effect means you accept the updated Terms.
